RIGHTS OF DAUGHTERS UNDER HUF

CAN DAUGHTERS BE THE CO-PARCERNER OF THE HUF ?

Yes. Daughters can be the Co-Parcener of the HUF.

The concept of a Hindu Undivided Family (HUF) has basically evolved from the Ancient Hindu Law. It has not been defined under the Income Tax Act or in any other statue. It has three basic essentials:

Only Hindus, Jains, Sikhs and Buddhists are covered under the HUF but not Muslims or Christians;
There should be a family i.e. group of persons and;
They should be undivided i.e. living jointly and having commonness amongst them.
Earlier only male members and unmarried daughters of the family were the Coparceners of HUF as it was believed that daughters have no right in the father’s property after marriage. But the Hindu Succession Act was amended in 2005 in order to remove the gender discriminatory provisions in the previous Act. As per Section 6 of the Hindu Succession (Amendment) Act 2005, the daughters have following rights:

The daughter of a coparcener cell by birth become a coparcener in her own right in the same manner as the son;
The daughter has the same rights in the coparcenary property as she would have had if she had been a son;
The daughter shall be subject to the same liability in the said coparcenary property as that of a son;
Any reference to a Hindu Mitakshara coparceners shall be deemed to include a reference to a daughter of a coparcener;
The daughter is allotted the same share as is allotted to a son;
The share of the pre-deceased son or a pre-deceased daughter shall be allotted to the surviving child of such pre-deceased son or of such pre-deceased daughter;
The share of the pre-deceased child of a pre-deceased son or of a pre-deceased daughter shall be allotted to the child of such pre-deceased child of the pre-deceased son or a pre-deceased daughter.
